Agreement
Acceptance and eligibility
These terms are a binding agreement between you and Cherokee Funding II, LLC, doing business as Cherokee Funding, for use of this website. By using the website, you agree to these terms and acknowledge the Privacy Policy. Do not use the website if you do not agree.
You must be at least 18 years old and legally able to enter an agreement to submit a funding request. Attorneys submitting for a client must be authorized by that client to provide the information and request contact about the case.
Information only
The website is not legal advice or an offer
Website content is general information. Cherokee is not a law firm, does not provide legal or tax advice, and does not control a legal claim. Nothing on the website creates an attorney-client, fiduciary or advisory relationship.
Descriptions of pre-settlement funding, lawsuit funding and plaintiff cash advances are summaries. Product treatment, terminology and availability vary by state. In South Carolina, the product is offered as a supervised consumer loan. The written agreement and required state disclosures control over website content.
Cherokee does not recommend or select a specific attorney. If you do not have an attorney, we may direct you to a state or local bar association lawyer-referral service.
Funding requests
Submitting an application
An online submission is a request for review. It is not an approval, offer, credit decision or guarantee that funding will be available. Eligibility and terms depend on state law, attorney representation, the legal claim and underwriting review.
You agree to provide accurate, current information and to update it if it changes. Do not submit information about another person unless you are authorized to do so. Cherokee may verify submitted information with the applicant's attorney or other lawful sources.
No funding relationship exists unless the applicant and the entity identified in a written agreement complete that agreement. The agreement will state the funded amount, charges, payment or payoff terms, cancellation rights and other applicable disclosures.

Calls, email and text messages
When you submit an application, you request contact about that application by phone or email using the information provided. Selecting the optional text-message checkbox provides separate consent for Cherokee Funding II, LLC and its servicer, Gain, to send automated text messages about the application. Consent to automated texts is not a condition of receiving funding. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.
Electronic communications may not be secure. Do not send medical records, Social Security numbers, bank information or other sensitive documents unless our team provides an appropriate method.
Use of the site
Acceptable use and ownership
You may use the website only for lawful personal or professional purposes related to learning about or requesting Cherokee services. You may not interfere with website security, use automated systems to extract content, submit false or fraudulent information, impersonate another person, introduce malicious code, or use the website in a way that violates law or another person's rights.
The website, its design, text, graphics, logos and other content are owned by Cherokee or its licensors and protected by intellectual property laws. Cherokee grants you a limited, revocable, nonexclusive right to use the website for its intended purpose. No other rights are granted.

Links to regulators, license records or other third-party websites are provided for convenience. Cherokee does not control those sites and is not responsible for their content, security or availability. Third-party terms and privacy notices apply when you use them.
Limitations
Website disclaimers and liability
The website is provided on an “as is” and “as available” basis to the extent permitted by law. Cherokee does not promise that the website will be uninterrupted, error-free or suitable for every purpose. Cherokee may correct, suspend or change the website at any time.
To the extent permitted by law, Cherokee and its affiliates, officers, employees and vendors will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of, or inability to use, the website. These limitations do not exclude liability that cannot lawfully be limited and do not alter rights under a completed funding agreement.
Nothing in these terms waives any remedy or right of a Georgia or Utah consumer, including punitive damages and the right to a jury trial.

Changes to these terms
We may update these terms as the website or law changes. The effective date at the top shows when this version took effect. Continued use after an update means the updated terms apply to later website use. Changes to these website terms do not change an existing funding agreement.
