Is lawsuit funding a loan?
In most states, Cherokee offers non-recourse funding rather than a traditional loan. Product treatment varies by state. In South Carolina, this product is offered as a supervised consumer loan. Review the product disclosures.
What if I lose my case?
Under a non-recourse funding agreement, if your legal claim produces no recovery, you owe Cherokee nothing. The written agreement and state-specific disclosures control.
Do I make monthly payments?
No monthly payments are due while the claim is pending. For non-recourse funding, the amount due is paid only from your recovery under the written agreement. Product treatment varies by state, including South Carolina's supervised consumer loan.
Are there upfront fees?
There is no fee to submit the website application. If approved, the written agreement states the funded amount, charges and payoff terms before you sign.

Your attorney
Does my attorney have to be involved?
Yes. Funding cannot be completed until an attorney represents you. We confirm the claim with your attorney and ask the attorney to acknowledge the funding before money is issued. Attorneys can review the client-funding workflow.
Will this hurt my relationship with my attorney?
Your attorney remains in charge of the legal claim. Cherokee does not direct litigation strategy or settlement decisions. Your attorney can review the agreement and discuss how the funding may affect your recovery.

What case types qualify?
We fund personal injury cases with an attorney of record, including car accidents, slip and fall, work injuries and medical malpractice. See the qualifying case types.
Is this available in my state?
Not in every state. Review the current state availability list or call to discuss your state. Selecting a state in the application does not establish eligibility.
The process
How long does it take?
Timing varies with the claim and how quickly we can confirm information with your attorney. Submitting an application is not an approval or a promise that funds will be available by a particular time.
Can I get more later on the same case?
Yes. You can apply for more on the same case. Each request is underwritten on the case as it stands then.
What if my case settles for less than expected?
For non-recourse funding, the amount due comes out of your recovery and does not exceed it. If your claim produces no recovery, you owe Cherokee nothing. Your written agreement and applicable state law control the precise amount due. In South Carolina, this product is offered as a supervised consumer loan.
Is this legal?
