The short answer
Cherokee Funding is based in Buckhead and has funded thousands of injury cases for clients of metro Atlanta law firms since 2011. Funding is repaid only from what the case recovers, and about half of the Georgia cases we fund are resolved within a year.

Where Atlanta injury cases are heard
Most Georgia injury lawsuits are filed in the State Court or the Superior Court of the county where the case belongs. Metro Atlanta spans four large court systems, and your attorney decides where your case is filed.
| County | Courts that hear injury cases | County seat |
|---|---|---|
| Fulton | State Court of Fulton County; Fulton County Superior Court | Atlanta |
| DeKalb | State Court of DeKalb County; DeKalb County Superior Court | Decatur |
| Cobb | State Court of Cobb County; Cobb County Superior Court | Marietta |
| Gwinnett | State Court of Gwinnett County; Gwinnett County Superior Court | Lawrenceville |
Many cases settle before a lawsuit is filed. Funding does not depend on which court hears the case, but it does depend on your attorney confirming the case with us.
How long cases take
Across the Georgia cases we have funded, about half were resolved within a year and about three in four within two years. The median case took roughly 10 months.
A few Georgia rules shape the clock. Most injury claims must be filed within two years of the injury. Once a lawsuit is filed, discovery usually takes months before a trial date is set. Your attorney can tell you where your own case stands.
What Georgia's 2026 law means for you
Since January 1, 2026, every company that funds Georgia lawsuits must register with the Georgia Department of Banking and Finance and follow new consumer rules. The ones that matter most before you sign:
- You can cancel within five business days of signing or of receiving the money, whichever is later, by returning the funds.
- If your case recovers nothing, you owe nothing beyond your recovery.
- The funder cannot direct your case, choose your lawyer or decide on a settlement.
- No one can be paid a referral fee for sending you to a funder, including your attorney.

Questions from Atlanta plaintiffs
Is pre-settlement funding in Georgia a loan?
No. In Georgia it is litigation financing, regulated by the Department of Banking and Finance. You repay only from what your case recovers, and if it recovers nothing you owe nothing beyond your recovery.
Does it matter which Atlanta county my case is in?
Not for eligibility. We fund cases in Fulton, DeKalb, Cobb, Gwinnett and the rest of Georgia. Your attorney confirms the case details with us either way.
How long do injury cases take to resolve?
For Georgia cases we have funded, the median is roughly 10 months, and about three in four are resolved within two years. Your own case may be faster or slower.
Can I cancel after I sign?
Yes. Georgia law gives you five business days from signing or from receiving the money, whichever is later. You cancel by sending notice and returning the funds, with no penalty.
